Any lawyer Moms on? My divorced sister with 3 dc has been mooching off my Dad for years. They currently pay her rent directly for her and one other large monthly bill. This has been going on for years (almost 4 yrs). If something would happen to Mom that she needs all of her monthly income, would she still be obligated to pay (historical obligation)?

    • of course arguments could be made on either side but, ultimately, i don't see any court requiring a parent to pay the expenses of their adult child when they need the money to live themselves.

      • np Even if they don't "need" the money, I doubt any court would say a parent was obligated to pay their grown dc's expenses. My mom bought my sister a house and gives her a few thousand a month. If she cut her off tomorrow, I don't see what recourse my sister would have (other than to get a job to support her kid).

        • The only reason I am asking is there was a custody dispute and my Mom sent a letter saying she would 'help'my sister stay in apt. with 3 dc if sister unable to do so. I am just concerned because M & D's nest egg significantly down and much less income each month (i.e not enough for sis' rent and Mom's home health care).

        • depends on whether there was a contract to do so. but if the parent needs the money (as in OP's hypothetical), i'm sure a court would say that warrants a rescission or modification.
