A person's effectiveness as a teacher, especially at the k-5 level, has much more to do with intangible personal qualities (ability to engage with the kids, respond flexibly to kids with different learning style, etc.) than to paper credentials. Schools try to improve the quality of teachers by raising barriers to entry, but this doesn't necessarily work. [ - ] I posted the other night - my dc fell at daycare and got a huge gash on his face requiring 17 stitches. DH is really on my case to start contacting lawyers, and when I tell him I don't think its necessary he blows up at me that I "don't care about protecting my family." DC was on the playground when it happened, was supervised but they say he tripped and hit his head on the corner of something sharp. If your DH wants to sue, let him do it. It will cost a fair amount of money, unless you can get a lawyer to take it for a cut of the compensation. The daycare does have liability insurance, so your DC may be able to get for pain and suffering, disfigurement, and subsequent plastic surgery to remove the scarring. [ Reply | More ]

This is my issue, I do think he was supervised but I don't think the playground is safe and I would like to see them address that. You need more information before you can decide whether it makes sense to sue. Can you find out exactly what happened, and in particular what DS hit his head on? If there is an unsafe condition on the playground like equipment that is not properly maintained, you could have grounds for a lawsuit (though the hassle involved might not be worth it). If there is no unsafe condition, and DS was reasonably supervised, you don't have a claim. Kids do get hurt all the time when they're not in any predictable danger. My own DD fell as a toddler, hit her head on a pretty small stone on the sidewalk, needed stitches and has a small scar. [ Reply | More ]

I'd add that the maximum damages you might recover for this type of injury are probably not huge, so you may not find an attorney willing to take the case on a contingent fee basis (ie for a cut of your recovery). If you have to pay by the hour, your legal fees could be steep. [ Reply | More ]

I'm the one with the addict mom. She's in a rehab hospital right now since collapsing from a cold turkey methadone withdrawal. I'm stressed because basically I'm not planning on calling her, and I don't feel good about it, but nothing positive has ever come from my trying. I call her expecting to be a daughter calling her mother, but nothing positive ever comes of it. She's just not "all there" and she's angry and bitter and it usually goes very poorly. op. It's funny. I never think of mother's day as having anything to do with me, because it was always supposed to be about my mother. I never expect anything. My mom always expected the world to stop for her celebration. I was also always supposed to call her on my birthday - because it is the anniversary of when she went through back-breaking labor, and she's the only one who really remembers the day. I was so well read and educated in HS. I just forgot most of it and my job requires a lot of reading and writing so when I am done, all I want to do it watch mindless shows or come on UB. They talk about home renovations and trips to Great Wolf Lodge and children's sports/dance lessons. Which is fine, but not that interesting. I would probably do some of my favorite activities - join an advanced French class or maybe learn Italian and take a Latin refresher class. The people in these classes are usually very cultured (the ones who attend the daytime classes at least) and the discussions are often fascinating, depending on the students.
